2. What personal data we collect
We collect personal data in two ways:
When you submit our demo form:
- Name (first and last)
- Work email address
- Company name
- Your role within your organisation
- Information about your contact centre operation (approximate interaction volume, primary platform)
- Whether your enquiry is for a product demo or a pricing/quote request
- Any additional information you choose to provide in the free-text field
When you browse this website:
- Technical data such as IP address, browser type, device type, and operating system
- Usage data such as pages visited, time on page, and referral source
- Cookie data, where you have consented to non-essential cookies
3. Why we process your personal data
We process personal data for the following purposes:
- To respond to demo requests - scheduling, preparing, and delivering personalised product walkthroughs, and following up afterwards. Legal basis: your consent when submitting the form, and our legitimate interest in responding to business enquiries.
- To improve our website and services - understanding how visitors use the site so we can improve content and performance. Legal basis: your consent for non-essential cookies, and our legitimate interest in site improvement.
- To comply with legal obligations - retaining records as required by tax, accounting, and data protection law. Legal basis: legal obligation.
- To communicate with you about our products - sending occasional updates relevant to your stated interest, where you have consented or where we have a legitimate interest and you have not objected. You have the right to object to direct marketing at any time, including when you first submit a form, by using the unsubscribe link in any marketing email or by contacting privacy@happypathlabs.com. Legal basis: consent or legitimate interest.
Where we rely on legitimate interest as a legal basis, our interests include the effective management of our business, responding to enquiries about Fizz, and the continuous improvement of our products and services. We balance these interests against your fundamental rights and freedoms and only proceed where ours are not overridden.
4. Automated processing and AI
The Fizz platform uses AI to assist with transcription, categorisation, and analytics of contact-centre interactions. These features run on customer data under our customers' instructions and are governed by the Data Processing Agreement we sign with each customer.
We do not perform automated decision-making that produces legal or similarly significant effects on individuals without human oversight, either on this website or within the Fizz platform.
5. Who we share your personal data with
We share personal data only with service providers who help us operate our business, and only to the extent necessary for them to provide their services. Our current sub-processors are listed below. The canonical, up-to-date list is maintained at Sub-processors.
- Amazon Web Services EMEA SARL - hosting, infrastructure, and transactional email for form submissions (Amazon SES) (EU region)
- Cloudflare, Inc. - bot-protection on our demo form (Cloudflare Turnstile)
- Google Ireland Limited - website analytics (Google Analytics 4)
- Salesforce Ireland Limited - customer relationship management
- Microsoft Ireland Operations Limited - email and productivity (Outlook, Microsoft 365)
All sub-processors are contractually bound to process personal data only on our instructions and in accordance with applicable data protection law. We do not sell personal data to third parties under any circumstances.
We notify business customers of planned changes to our sub-processors by updating the Sub-processors page. Customers under contract receive advance notice of material changes through the channel set out in their Data Processing Agreement, with a reasonable period to object.
We may also disclose personal data where required by law, court order, or regulatory authority.
6. International transfers
All personal data is primarily stored within the European Economic Area. Where any sub-processor transfers data outside the EEA (for example, to support services provided from non-EU jurisdictions), such transfers are made under appropriate safeguards including the European Commission's Standard Contractual Clauses and, where applicable, the EU-US Data Privacy Framework.
7. How long we keep personal data
We retain personal data only as long as necessary for the purpose it was collected:
- Demo requests that do not result in a customer relationship: approximately 24 months from your last engagement with us.
- Non-responsive enquiries: approximately 12 months from initial contact.
- Data relating to customer relationships: for the duration of the relationship and up to 7 years after it ends, to meet our accounting, tax, and audit obligations under Irish law.
- Website analytics data: in accordance with our analytics provider's standard retention settings (typically 14 months for Google Analytics).
After these periods, data is securely deleted or anonymised.
Retention periods are documented in our internal Data Retention Schedule, which is reviewed annually as part of our ISO/IEC 27001:2022 information security management system.
8. Your rights
Under EU GDPR and Irish data protection law, you have the following rights:
- Right of access - to request a copy of the personal data we hold about you
- Right to rectification - to request correction of inaccurate or incomplete data
- Right to erasure ("right to be forgotten") - to request deletion of your data, subject to certain exceptions
